Executive Order Suspends De Minimis Treatment
On July 30, 2025, President Trump signed an Executive Order (EO) suspending the long-standing De Minimis treatment for imports into the United States. This change will take effect on August 29, 2025, and will significantly impact importers, shippers, and businesses that rely on low-value shipments.

What Is De Minimis Treatment?
Under the previous rules, shipments valued at $800 or less could enter the US duty-free, avoiding customs charges and complex entry requirements. This was a cost-saving measure widely used by importers and e-commerce businesses.

Now, with the suspension in place, all imports (excluding postal shipments, certain bona fide gifts, and personal items) will be subject to duties and entry processing, regardless of value, country of origin, or transport mode.

What This Means for Importers

  • No more duty-free threshold – All low-value imports now subject to customs charges.
  • Shipments from China/Hong Kong > $250 → Require Formal Entry + Importer Tax ID (EIN).
  • Shipments from other countries > $2,500 → Require Formal Entry + Importer Tax ID.
  • Duties/Taxes must be paid or billed before release of shipment.
  • All shipments will require Informal or Formal Entry, depending on value, commodity, and country of origin.

How to Avoid Delays in Customs
With this shift, preparation and documentation are critical. Importers should:

  • Do not undervalue shipments – risk of holds, fines, or penalties.
  • Include your Tax ID (EIN) on commercial invoices.
  • List HTS Codes for all goods shipped.
  • DHL account holders – Enter your Import Account Number in the Customs Billing field on the Air Waybill to avoid delays.
  • Non-account holders – Be ready to respond quickly to carrier requests for payment (Credit Card or ACH).
  • Consider DDP (Delivery Duty Paid) terms – Work with suppliers who can cover customs charges upfront.
